The purpose of this document is to explain how our Platform works, particularly with regard to the following points:

• Creating and deleting an Account,
• Intellectual property,
• The use of artificial intelligence tools.

This will help you understand the relationship between “you,” the Platform user, and “us,” EducaZone, a simplified joint-stock company, as well as our two subsidiaries, EducaZone Inc. and EducaZone Limited, which provide our Platform so that you can benefit from our Courses and Learning Paths.

Before browsing the Platform, you acknowledge that you have read and accepted, by checking the box, the entirety of the Terms of Use (TOU) and our Privacy Policy.

Furthermore, we may modify our Terms of Use at any time to adapt to changes to the Platform (such as the introduction of new features or the removal or modification of existing features). If you continue to use the Platform after such changes, this means that you accept the updates without reservation. The Terms of Use that will be binding on you will be those in effect at the time of your use of the Platform. Please be sure to review this document regularly to stay informed of these changes.

Please note: if you do not agree with the entire content of the Terms of Use—either at the time of registration or when updates are made—you will not be able to use our Platform or our services.

How Our Platform Works

How Do I Access the Platform?

If You Are a Visitor

Use of our Platform is free and involves no obligation to purchase.

You can use our Platform even if you have not created an Account. In that case, you are considered a visitor.

In this case, you can access the Platform but will not be able to use all of its features. Specifically, certain areas will be restricted, such as access to our Courses.

If you are a Member

If you wish to access our Courses and/or Learning Paths and certain features, you must create an Account, as described below.

Once you’ve done so, you’ll be able to access your profile page and enter your information. Please note: some fields are required, while others are optional.

You can access all the Courses available on our Platform, as well as our quizzes, for free. However, there is a fee for issuing a certificate of completion, unless you’ve completed a Learning Path. In that case, the certificate is included in the course price.

What are the requirements for registration?

As mentioned, access to certain features of our Platform requires an Account.

You must meet several requirements for your registration to be valid:

• You must be 16 years of age or older.
• You must have read and accepted the Terms of Service and the Privacy Policy.
• If you are between 16 and 18 years old, or are subject to a legal protection measure (court-ordered guardianship, conservatorship, or trusteeship), your legal guardians or your representatives/guardians/trustees must also read and accept all of the documents.

How do I create an account?

You can create an account in two ways:

Manual registration on our platform | Registration via a third-party account (Google, Facebook, Apple, etc.)

Fill out the registration form by providing the required information, including your last name, first name, date of birth, and email address. * For more information, see our Privacy Policy. * If you fill out our registration form directly for one of our Learning Paths, you will be asked for additional information. Click the button provided for this purpose. This feature allows us to collect the information necessary for your registration. You can remove the link between your account and the account created on EducaZone at any time. *Be sure to review the terms of use for these sites before authorizing the connection to our Platform.

Regardless of the option you choose, you will receive an email with a temporary password, which we encourage you to change the first time you log in to our Platform.

When creating your Account, you must:

• Provide true, accurate, and complete personal information and update it whenever necessary, until your Account is deleted. EducaZone will not be liable for any errors, omissions, or inaccuracies in the information you provide to us, nor for any harm that may result to others.
• Have only one account—that is, do not create or use, under your own identity or that of a third party, any accounts other than the one initially created. You may not authorize third parties to use your Account or transfer it to any other person or entity.
• Keep your username and password confidential. Never share them with anyone else. Your username and password are strictly personal and confidential.
• Comply with applicable laws.

The information you provided during registration can be corrected during the registration process by returning to the previous screens and correcting any incorrect information. Afterward, you can access, modify, and/or delete your information from your Account at any time.

What should I do if my username or password is lost or stolen?

If you’ve lost your password, it’s easy!

Go to the Platform and follow the procedure by clicking the “Forgot Password” link.

If, on the other hand, you believe that your username or password has been used by someone other than yourself, please notify us immediately by sending an email from the email address you provided when creating your Account via our form.

How do I delete my Account?

If you created an Account and haven’t started a Course, you can delete it yourself by following the steps below:

1. Log in to your Account,

1. Go to “My Settings” in the drop-down menu at the top right of the Platform, next to your avatar (your initials),

1. Scroll to the very bottom of the page to “Return to your settings to edit your forum, payment, and preference information,”

1. Go to the Settings tab,

1. Click “I want to delete my account” at the bottom of the page,

1. Confirm the deletion of your account.

This cancellation will take effect within thirty

 

(30) business days from the date EducaZone receives your request to unsubscribe.

If you have created an Account and completed one or more Courses, you can request the deletion of your Account via our form.

However, we are required to retain certain data for as long as necessary to fulfill the purposes for which it was collected, in accordance with legal requirements and our Privacy Policy. In such cases, this data will be archived using stringent security protocols, and access will be limited to a select few individuals.

Please feel free to review our Privacy Policy, and if you encounter any difficulties or have questions, you can also contact our support team via our form.

Platform Outages and Malfunctions

We are committed to doing everything possible to ensure the Platform operates smoothly.

However, access to the Platform may be interrupted, in particular for the following reasons:

• Maintenance and in case of an emergency;

• Updates (technical upgrades, etc.).

These interruptions are intended to ensure the long-term viability and performance of our Platform.

Despite our efforts, the Platform may malfunction. In such cases, we will make every effort to resolve the issue as soon as possible. We shall not be held liable for this reason, regardless of the cause, duration, or frequency. You will also not be entitled to any indemnity or compensation of any kind.

Furthermore, if you misuse the Platform, you acknowledge that some of your data or materials, for example, may be compromised (loss, alteration, exposure, etc.).

What are your obligations?

You must not:

• Collect information about visitors or Members to send them unsolicited messages and/or include them in a search engine or similar service, whether free or paid.
• Post information and/or messages, comments, or other content that is malicious, disparaging, defamatory, abusive, obscene, pornographic, violent, racist, xenophobic, discriminatory, intentionally misleading, illegal, and/or contrary to public order or morality.
• Impersonate another visitor, Member, or third party in a manner likely to mislead or create any confusion regarding their identity or the source of the information or content (courses, messages, comments, etc.) they post or transmit on the Platform.
• Alter or disrupt the integrity of the Platform and/or the data contained therein.
• Replace any security feature or circumvent or bypass any access controls.
• Post or upload anything containing viruses, computer worms, or any other harmful code.
• Reverse engineer, decompile, disassemble, decrypt, or, in general, attempt to obtain the source code of the Platform or any related technology that is not open source.
• Monitor the availability,

• performance, or functionality of the Platform for competitive purposes.
• Do not attempt to gain unauthorized access to the Platform or to any systems or networks associated with it, or to intercept data.

Intellectual Property

What are our intellectual property rights?

We own all rights, including intellectual property rights, or have obtained the necessary authorizations from third parties regarding the technical, graphic, textual, or other elements—whether visible or not—on our Platform, as well as the elements associated with the services we provide to you. For example, these may include text, graphics, software, multimedia files, photographs, images, videos, sounds, plans, graphic design guidelines, technology(ies), source codes, names, trademarks, logos, visuals, databases, etc. (hereinafter “Elements”).

Consequently, unless you have obtained our prior written consent, you may not:

• Make the Elements available to third parties, whether for free or for a fee, in whole or in part, without the prior written consent of EducaZone or the rightful owner.
• Develop, implement, or use software, devices, scripts, bots, or any other means or process (including web crawlers, browser extensions and add-ons, or any other technology) intended to scrape data from the Platform or otherwise copy Member profiles and other data from the Platform, whether directly or indirectly.
• Damage the reputation of visitors, Members, EducaZone, and/or its subcontractors.
• Infringe upon the intellectual property rights of EducaZone, Members, or any third party, including but not limited to copyrights, patents, trademarks, trade secrets, or any other rights, such as privacy or the right of publicity.

Finally, please note that you may be held civilly and/or criminally liable if you use the Materials without our consent.

What rules apply to our Courses and Learning Paths?

Our Courses are protected by one or more intellectual property rights, of which we are the owners or co-owners when created with one of our partners.

Since our mission is to make education accessible, we have chosen to license our Courses under a Creative Commons license. This means that we retain ownership but grant you broad permission to use them.

Unless otherwise stated, they are generally published under the CC-BY-SA license. This means you can share and modify the content, provided that you credit us and share your changes under the same license we have chosen.

Before using any content, you must therefore review the full text of the license associated with our Course to verify whether such use is permitted under that license.

For more information on Creative Commons licenses, you can visit the website of the international organization “creativecommons.org.”

As for our Learning Paths, they remain our exclusive property, and you may not use them without our written permission.

What are your intellectual property rights regarding your content?

You retain ownership of the rights to the content you produce as part of your training. This may include, in particular, your projects.

However, in exchange for using our Platform, you grant us a worldwide, non-exclusive, transferable, sublicensable license allowing us to copy, store, correct, adapt, and distribute all of your content, including projects and any other activities you perform on the Platform or for the purposes of your course.

This license is granted as and when such content is published and terminates upon its deletion.

By posting this content online, you warrant to us that you hold all rights to it (intellectual property rights, personality rights, privacy rights) and, more generally, that your content does not infringe upon the rights of third parties or violate applicable laws. In the event of a dispute, you may be held liable on this basis.

What happens if you click on a hyperlink?

Our Platform may link to internal or external websites via hyperlinks.

By clicking on them, you understand that you are no longer on our Platform and thereby agree that we are not responsible for the information published on those sites, its accuracy, or their privacy or security practices. You browse at your own risk. Nor can we be held liable for any damage or loss caused or alleged to be caused in connection with the use of these external sites.

Discussion Forums

You can access Discussion Forums where you can view messages posted or exchanged with other Members.

Please be aware that any messages you post will be visible to all Members. We therefore recommend that you use private messaging systems if your conversation is intended for only one person.

Furthermore, when you post a message, you agree to comply with the rules of the Code of Conduct described below.

What Does Our Code of Conduct Include?

Our Platform features one or more Discussion Forums, such as the forum, based on mutual support and sharing among Members.

Everyone is invited to participate by creating an account here or on our external sites, such as the platform dedicated to our EducaZone community.

Regardless of where you post your messages, you must comply with legal requirements and basic rules of courtesy.

Therefore, you agree to:

1. Respect other members: Treat others as you would like to be treated. Do not use language or content that is offensive, obscene, defamatory, abusive, harassing, racist, sexist, homophobic, hateful, or discriminatory, and do not incite others to commit acts of terrorism.

1. Communicate clearly: Ensure your messages are understandable and free of misinformation. Use appropriate language; do not write messages entirely in uppercase letters, and avoid overly technical jargon unless the context requires it. Be careful not to use abbreviated language, and check your spelling.

1. Maintain a friendly atmosphere: Foster a positive environment; appreciate others’ contributions and offer constructive feedback when you disagree. Messages posted multiple times, off-topic, or intended to stir up controversy will not be published.

1. Be honest and act with integrity: Do not attempt to deceive others by pretending to be someone else, and do not impersonate others.

1. Protect your privacy: Never share personal information about yourself or others unless you have their written consent.

1. Do not send spam or advertisements: Do not use our discussion forums for advertising, spamming, or self-promotion.

1. Respect intellectual property rights: Post only content for which you own the rights or have the author’s express permission, and properly cite your sources.

1. Contribute constructively: Help us maintain the quality of the content by reporting any abuse and by avoiding participation in discussions that violate this Code of Conduct.

We count on you to follow these principles to maintain a safe, welcoming, collaborative, and respectful community.

What are the goals of moderation?

You can post messages, content, or information directly, without any prior review on our part.

However, they may be moderated after the fact by us if they are reported following publication.

Our role is to ensure the smooth operation of the Discussion Forums, which means that violations of the Code of Conduct or applicable laws may result in sanctions ranging from a warning to permanent exclusion from the community or even from the Platform.

How can you report content to us?

You can report any message—and, more generally, any content published in the Discussion Forums—that violates the Terms of Service or any legal provision.

To do so, you have several options:

• Either use the option to report content directly on the platform dedicated to our EducaZone community,
• Or via our form,
• Or by using the form available on the Platform by clicking the “Contact Us” tab.

Your report must include the following information for your request to be processed:

• Your identity (last name, first name, email address);
• The exact URL of the disputed content, along with a sufficiently detailed explanation justifying why it is unlawful;
• A copy of the message you previously sent to the author of the content requesting its modification or removal, and/or an explanation of why you were unable to contact that author.

In response to a report, we may remove content that is clearly unlawful or does not comply with the Terms of Service.

The Use of Artificial Intelligence Tools

We place innovation at the heart of our educational approach and our commitment to a superior user experience. With this in mind, we use artificial intelligence tools (“AI Tools”) with the goal of improving the services we offer you.

These AI Tools allow us to personalize your learning journey, optimize the relevance of the courses we recommend to you, and refine interactions within our Platform to make them more intuitive in relation to your needs. We also use these AI Tools to create and update the videos embedded in our Courses and Learning Paths.

AI Tools Made Available to You

In addition to the AI Tools mentioned above, we also provide you with AI tools to enhance your interactions with Members or personalize your learning experience.

In this context, we grant you a worldwide, revocable, non-exclusive, non-sublicensable, and non-transferable right to use them—in particular to generate content—for the duration of your paid training, in accordance with these Terms of Use, the general terms of service, or the contract you have signed with us, the EducaZone Code of Ethics, and applicable laws.

Consequently, if you use them, you are responsible for the data you incorporate, including ensuring that it does not violate any applicable law or the documents binding you to us. You represent and warrant that you have all necessary rights, licenses, and authorizations to incorporate data into these AI Tools.

Finally, you must not include personal or sensitive data in your messages or content unless you have obtained the consent of the individuals concerned. Otherwise, you must, at a minimum, pseudonymize your searches.

Ownership of Generated Content

You retain ownership of the data you enter during your search. Additionally, you also own the data and content you have generated using our AI Tools.

We hereby assign to you all intellectual property rights, if any such rights are eligible for protection. However, the transfer of rights to you does not extend to content produced by other Members or by third parties.

We also draw your attention to the fact that results may not be unique, and other Members may receive similar results due to the nature of artificial intelligence.

Data Storage

When you enter data into our AI Tools, we may store your message history in order to display it to you as a history if the AI Tool allows it and we have authorized it.

Under these conditions, you authorize us to use your data and outputs to improve our models and services. For more details on data privacy and security, please refer to the Microsoft Azure documentation, available on its website.

However, if your content is hosted on third-party servers, it is under no circumstances shared with third parties or used to train their tools.

Prohibited Uses

You must not use our AI Tools for any illegal, harmful, unethical, or prohibited purposes under applicable law, including, but not limited to, the following:

• Any surveillance of EducaZone employees, Members, or any third party, whether in private or public places;
• Any discriminatory or exploitative purpose likely to result in harm or unfair treatment of students or third parties;
• Any purpose that violates the right to privacy or data protection
• of individuals;
• Any purpose that infringes upon the intellectual property rights of EducaZone or a third party;
• Any attempt to misuse, circumvent, or exploit our AI Tools in a manner not authorized by the Terms of Service or any other EducaZone document and/or that does not comply with the intended purposes.

How is your personal data protected?

We take the protection of your personal data very seriously.

That is why we have drafted our Privacy Policy, which provides a detailed description of how we use your personal data, the reasons why we do so, and our use of cookies. Please feel free to read this document to learn more.

In what circumstances can we be held liable?

We are liable for all content over which we have editorial control. For example, this may include our Courses, our Learning Paths, or information related to them.

In such cases, and if our liability is proven, we will be liable only for direct damages to the affected individuals.

Indirect damages resulting from the use of the Platform—such as operating losses (revenue, income, or profits…), loss of business opportunities, damage to image or reputation, or commercial or economic harm—are not covered.

Exceptions

Your Content

All content created and published by you or a third party is your or their responsibility.

We act as a host for the information and content posted by you or such third parties on the Platform. This means that we have a limited liability regime and are required to remove illegal content only upon receiving a report, the procedure for which is described above.

Causes Beyond EducaZone’s Control

We shall not be held liable for any damages resulting from your actions, difficulties inherent in the operation of the Internet and, more generally, telecommunications networks of any kind, acts of third parties, or force majeure.

Data Loss

Any data loss you may experience, even if caused by EducaZone, will not be compensated.

Force Majeure

Neither you nor we shall be liable if an event occurs beyond your or our control that could not reasonably have been foreseen at the time of acceptance of the Terms of Use and whose effects cannot be avoided by appropriate measures.

In the event of force majeure, neither you nor we will be obligated to fulfill our commitments for as long as such an event persists.

However, the affected party will endeavor to mitigate the consequences to the greatest extent possible. Failing that, and if the force majeure event is permanent, neither party will be required to fulfill its commitments, and we will jointly determine the consequences of such an event on our relationship.

Disputes

These Terms of Use are governed by French law.

In the event of a dispute regarding the validity, application, or interpretation of these Terms of Use, you and we agree to seek an amicable resolution within three (3) months before bringing the matter before the courts.

Only the courts within the jurisdiction of the Paris Court of Appeal shall have jurisdiction to hear the dispute, regardless of the place of performance or the defendant’s domicile, and this attribution of jurisdiction also applies in the event of summary proceedings, multiple defendants, or third-party claims.

Definitions

The terms below have the following meanings in this document:

AccountA Member’s personal space that allows them to access the Platform’s paid services.

CourseVideo resources, online readings, quizzes, and exercises to help students achieve their learning goals.

Discussion ForumsOnline spaces, whether internal or external, where Members can post messages, interact, and exchange ideas on various topics related to EducaZone’s training programs or activities.

MemberA person who has an Account on our Platform.

Learning PathAn online educational experience that includes projects, Courses, and mentoring sessions.

PlatformA digital platform, such as a website and/or mobile app, that provides access to and enables the use of online training services.

SPECIAL TERMS AND CONDITIONS FOR THE RECRUITERS’ AREA

The Recruiters’ Area is a dedicated section of the Platform made available to anyone wishing to access the profiles of candidates seeking a work-study job opportunity, under the conditions described below.

Access to and use of the Recruiter Area are subject to the Recruiter’s unconditional acceptance of and compliance with all contractual documents provided by EducaZone, such as the Platform’s General Terms of Use (GTU) and these Special Terms. Failure to do so will result in the Recruiter being unable to access the Recruiter Area.

EducaZone reserves the right to modify, at any time and without notice, the Recruiter Area, as well as the contractual documents referred to above, in particular to adapt to changes in the Platform (introduction of new features, removal or modification of existing features, etc.). In the event of any conflict, the Special Terms and Conditions shall prevail.

1. Definitions

In addition to the terms defined in the Terms of Use, the words below have the following meanings:

Candidate: refers to a natural person of legal age, or a minor (with the consent of their legal representatives), regardless of their status, who wishes to be connected with one or more Corporate Recruiters to find a work-study job offer.

Special Terms: this document, which describes the terms of use for the Recruiter Area accessible to Recruiters on the Platform.

Account: refers to the service that allows Recruiters to access the Recruiter Area using their work email address and password.

Platform: refers to the website accessible at “EducaZone.net,” which is published by EducaZone SAS (legal notices).

Recruiter(s): refers to a natural person responsible for recruitment within a Company or on behalf of the Company and who is authorized to act in this capacity.

Recruiters’ Area: refers to all or part of the services and features made available to Recruiters by EducaZone on the Platform.

Company: refers to the legal entity, professional employer in the private or public sector, established in the Territory specified in the Special Terms and Conditions.

Territory: refers to France, including the overseas departments and regions (DROM-COM), the United Kingdom, and the United States.

2. Overview of the Recruiter Area

The Recruiter Area of the Platform facilitates the connection of willing Candidates with Recruiters, and more specifically allows Recruiters to:

• Access EducaZone’s Candidate database, which includes their resumes, last name, first name, email address, phone number, place of residence (region), professional experience, skills, language proficiency level(s), education, biography, links to social media or websites, job search field, and desired start date for a work-study program.
• Find a profile that matches their hiring needs.

This Recruiters’ Area is open to all recruiters based in the region.

3. Registration - Account Deletion

Registration

Access to and use of the Recruiters’ Area are contingent upon the recruiter’s registration on the Platform.

The Recruiter must therefore meet the following four conditions:

• Be a natural person of legal age and of sound mind, working within the Company or on behalf of the Company;
• Create an account on the Platform;
• Accept all contractual documents provided by EducaZone, including the Terms of Use and Special Terms and Conditions;
• Use the Recruiter Area strictly for professional purposes.

Upon registration, the Recruiter:

• Agrees to provide accurate, truthful, and up-to-date information and documents, and to regularly verify their data to ensure its accuracy.
• Confirms that they have all the necessary authorizations to recruit on behalf of the Company.

The Recruiter must also provide a valid email address, to which EducaZone will send confirmation of their registration in the Recruiter Portal. In this case, the Recruiter will receive a username and password. The Recruiter may change the password online via their Account. The username and password are personal and confidential. The Recruiter therefore agrees not to disclose them to third parties and, in the event of loss or theft, agrees to notify EducaZone immediately.

Account Deletion

EducaZone may also suspend or delete, temporarily or permanently, any Recruiter’s Account, particularly in the following cases (non-exhaustive list):

• Breach of contractual documents, including the Special Terms and Conditions;
• Provision of false, inaccurate, outdated, or incomplete information;
• An Account that has been inactive for at least one year, counting from the date of registration in the Recruiters’ Area, unless otherwise required by law.

EducaZone may also, in any of these cases, deny the Recruiter future access to all or part of the Recruiters’ Area.

Should EducaZone decide to delete the Recruiter’s Account for any of these reasons, such deletion shall not constitute damages to the Recruiter whose Account has been deleted, which the Recruiter expressly accepts.

Nor does such deletion constitute a waiver of any judicial or extrajudicial legal action that EducaZone may take against the defaulting Recruiter.

4. Recruiters’ Obligations

General Commitments

Every Recruiter agrees to:

• Provide accurate, complete, and up-to-date information;
• Not create a false identity on the Platform and/or the Recruiter Dashboard, impersonate a third party, create a profile for anyone other than themselves, or use or attempt to use another person’s account;
• Use Candidates’ data solely for professional purposes, namely to offer a work-study position within their Company;
• Do not contact Candidates for any purpose other than recruitment (marketing, surveys, etc.);
• Contact, via the email address provided on the Platform and/or the Recruiter’s Area, only those Candidates who:
• Are located in the same country as the Recruiter;
• Are authorized to work in the country specified in the work-study job offer;
• Conduct all necessary background checks (social security, tax, etc.) if the recruitment process with the Candidates proceeds;
• Delete Candidates’ resumes within 6 months of downloading them;
• Comply with all applicable laws in the jurisdiction where the work-study job posting is located.

Furthermore, if a connection is successfully established between a Recruiter and a Candidate through EducaZone’s Recruiter Portal, the Recruiter agrees that the Candidate will complete their training through the programs offered by EducaZone.

Finally, Recruiters are prohibited from:

• Replace any security feature or circumvent or bypass any access controls;
• Make personal or non-personal data available to third parties, whether free of charge or for a fee, in whole or in part, without the prior written consent of EducaZone or the legitimate data owner;
• Develop, support, or use software, devices, scripts, bots, or any other means or process (including web crawlers, browser extensions and add-ons, or any other technology) intended to perform web scraping of the Recruiters’ Area or otherwise copy Candidate profiles and other data from the Recruiter Area, whether directly or indirectly;
• Use computer bots or other automated methods to access the Recruiter Area;
• Post or upload anything containing viruses, computer worms, or any other harmful code;
• Reverse engineer, decompile, disassemble, decrypt, or, in general, attempt to obtain the source code of the Recruiter Area, the Platform, or any related technology that is not open source;
• Monitor the availability, performance, or functionality of the Recruiters’ Area for competitive purposes;
• Damage the reputation of the Company, the Candidates, and/or EducaZone;
• Infringe upon the intellectual property rights of EducaZone, Candidates, or any third party, including but not limited to copyrights, patents, trademarks, trade secrets, or any other rights, such as privacy or the right of publicity.

Ethical Values

As a mission-driven and B-Corp-certified company, EducaZone’s ethical values include acting as a responsible employer and pursuing a socially responsible environmental policy. Our ethical values are detailed in our Code of Ethics, available on our website, which the Recruiter agrees to adhere to. Furthermore, the Recruiter shall refrain, directly or indirectly, from carrying out, participating in, or executing any act, action, or attempt that could be deemed a violation or breach of these commitments.

In the event of a suspected violation or breach of the principles of the Code of Ethics that could harm EducaZone’s brand or reputation, EducaZone shall have the right to delete the Recruiter’s Account without prior notice, and without prejudice to any judicial or extrajudicial proceedings and any damages to which it may be entitled.

5. EducaZone’s Obligations

EducaZone undertakes to ensure the Platform’s accessibility 24 hours a day, 7 days a week, subject to scheduled maintenance periods (for informational purposes, these maintenance operations last between 1 and 4 hours per session and are scheduled during times when traffic on the Platform is at its lowest) .

However, EducaZone makes no commitments regarding:

• The number of Candidates;
• Responses from contacted Candidates;
• The frequency of updates to new profiles;
• The match between Recruiters’ search criteria and the profiles of Candidates visible on the Platform, as well as their availability.

6. Pricing

Access to the Recruiter Area on the Platform is provided free of charge.

7. Liability

EducaZone shall not be liable in the following cases:

• No warranty regarding the content, accuracy, completeness, or relevance of Candidate profiles or their suitability for Recruiters’ needs;
• The removal of content, profiles, Accounts, or information to comply with legal and regulatory provisions;
• The verification of information—particularly social security and tax information—regarding Candidates selected by Recruiters, as this obligation rests with the Recruiters;
• Communications and contractual relationships between Candidates and Recruiters, as well as any disputes;
• In the event that a Candidate declines a work-study job offer, for any reason whatsoever;
• A lack of skills on the part of Candidates in the event of their recruitment by the Company.

8. Confidentiality

The Recruiter agrees to respect the confidentiality of any information, whether personal or not, to which it has access (“Information”), which remains the exclusive property of its owner.

The Recruiter agrees to:

• Not disclose, use, transfer to a third party, translate, or adapt the Information, outside the purposes for which it was made available, in part or in full, directly or indirectly, in any form or medium whatsoever.
• Take all necessary measures to ensure the security and confidentiality of the Information;
• Not to file the Information as intellectual property or as trade secrets, either in its own name or through a third party, in France or abroad;
• Notify EducaZone as soon as it becomes aware of any leak of Confidential Information.

This obligation takes effect upon the Recruiter’s registration, remains in force for the entire duration of the Account’s validity, and continues for a period of 2 years following the Account’s closure.

9. Protection of Personal Data

EducaZone and the Recruiter acknowledge that they are fully aware of the obligations arising from the General Data Protection Regulation 2016/679 of April 27, 2016 (hereinafter “GDPR”) and any other applicable regulations regarding the protection of personal data that apply to them in their respective capacities as Data Controllers for the operations they carry out, independently, each in the course of their own business activities.

Accordingly, EducaZone and the Recruiter shall, each in their respective capacities, take all necessary measures to ensure compliance with these regulations in connection with the performance of the Special Terms, in accordance with the privacy policy available on the Platform.

EducaZone and the Recruiter agree that, upon registration on the Platform, the performance of the services and obligations incumbent upon either party under the Special Terms and Conditions shall not, under any circumstances or for any reason whatsoever, involve the Processing of Personal Data by one Party, acting as a Processor, on behalf of the other Party, acting as a Data Controller within the meaning of the GDPR.

In the event that EducaZone or the Recruiter, for any reason whatsoever, should ultimately proceed, directly or indirectly, to process Personal Data in the course of fulfilling its obligations under the Special Terms, on behalf of the other Party, it is expressly agreed that the latter shall act as a processor within the meaning of the GDPR.

In this context, EducaZone and the Recruiter undertake to enter into any agreement or binding legal instrument defining and specifying, in particular: (i) the purpose and duration of the Processing; (ii) the nature and purpose of the Processing; (iii) the type of Personal Data, (iv) the categories of Data Subjects, (v) the obligations and rights of the Data Controller and the Processor, (vi) the procedures for communication between them, (vii) the level of security applicable to the Processing, as well as, in general, all the obligations listed in Article 28-3 of the GDPR.

10. Governing Law and Jurisdiction

The interpretation and validity of the Special Terms and Conditions shall be governed by the laws of Côte d’Ivoire.

In the absence of an amicable settlement within four (4) months, any dispute concerning the conclusion, entry into force, interpretation, application, or termination of the Special Terms and Conditions may be brought before the competent courts of Abidjan, Côte d’Ivoire.
